Throwaway because the subject matter is sensitive and embarrassing. I don't want anyone I know connecting me to this.

I am 41M and I have a brother who is also 41. My brother and I share the same birthday, and because of this my parents always tried their hardest to make sure we were treated equally, and encouraged to be friends with each other. We weren't close at all growing up, and we went to separate colleges. We went into completely different careers, but we have remained in touch and we still visit each other when we can, because it's what our parents want.

My brother got married about 6 years before I did. Both of his marriages ended in a divorce, and the second one was a nasty one. After the divorce from his second wife was settled, he took a break from everything to clear his head. He rented a small cabin on a lake and took a break from work to clear his head and get his life back together. He ended up liking it so much he bought the property. He recently decided to make this his primary home. He did a major renovation on the cabin to turn it into a full sized house.

Over the Christmas holiday we took our children to my parents house to visit with extended family. I invited my brother to stay the whole week with us, but he declined. However he did decide to stay the night for Christmas Eve, and Christmas night.

On the morning of December 26, I woke up to make a pot of coffee. As I was standing in the kitchen I noticed my brother's car was gone. He had texted me to say he was leaving at 6:00am sharp, so that made sense. I went to put his luggage in his car but that wasn't there either. I thought it was weird but figured he was already on the road.

Later on my wife asked me what I did with his luggage, and I told her I didn't see it. She told me it was on the floor in the bedroom, and that she was surprised I didn't see it as she thought it was right next to his other luggage.

I went to the room and got the luggage, put it in the car, and set off in the direction of his house. He lives about 4 hours away, but it's a straight shot on the highway, so it's not too bad of a drive.

About 30 minutes from my house I got a text from my brother asking what the hell was I doing. I told him I was bringing him his luggage since he forgot it, and he said he specifically put it in his car before he left so I could turn around and go home.

When I got to his house, I was finally met with what was really going on. My brother had never left my house on the morning of December 26. Him and his car had been parked about a block away from my house, and he had walked back during the night. When he got to his house, he opened the front door and walked in on me in the kitchen. He stood there and watched me get ready for the day, then snuck into my bedroom and stole my wife's underwear and some of her clothing, put it in a duffel bag, and put it in his car. That's why he made the comment about the luggage being right next to his other luggage. Then he drove back to his house.

I was angry at first that he thought it would be so easy to lie to me and get away with it. He could have gotten in a lot of trouble had a cop pulled him over. He did this whole thing just to steal underwear? It made no sense to me.

When I got home I asked my wife about it. I asked her if she had ever met my brother before, and she said she had not because he lived across the country, but she saw him at the wedding. I asked her if at any time she had ever sent him a pair of her underwear, and she said no.

So now I started to feel like a total idiot. The only thing that made sense to me was that my brother broke into my house to steal underwear from my wife's dresser. I thought this was impossible until I remembered that my parents had split up the cost of a pair of key locks for my brother and I when we got our first apartments. We still have these locks on our front doors, and the keys are the same.

I didn't say anything to my wife about it, but during the first week of January she went to stay with her parents for a week. She was only 30 minutes from work, and she figured it would be a good chance to spend time with her family who she hadn't seen in over a year.

One night while she was gone, I came home from work and everything was normal. It was raining and it was cold outside, so I didn't bother looking around the house at all. I went into the bedroom to change and my brother was standing there.

He was standing in my closet naked, and he had pictures of my brother's wife on his phone that he was using to pleasure himself with. He looked at me, finished his deed, and walked out of my house.

I immediately went and changed the locks on everything. I installed security cameras on the inside and outside of the house. I decided not to call the police because I didn't want to ruin my brother's life over it. The next day I told my wife what happened, and she is frantic. She refuses to come home and said I need to get a restraining order against him.

I went to the courthouse last week and filed the necessary paperwork. I received an email from my brother this week. He apologized for everything, and begged me to not go through with it because it will break our parents hearts. He said he was going to seek counseling for everything, and he begged me to call off the restraining order. I haven't responded, because every time I think about it I'm angry.

My parents know something is wrong, but neither of us has told them what's going on. I don't want to ruin their lives but something needs to be done. The restraining order is going to be hard to keep up because he is allowed to be at our parent's house.

What should I do?

Edit: Let me answer some questions. It was the same pair of locks, but not the same locks. We both took our locks with us when we moved out. We both still had the locks, and we both had keys, because our parents made sure we had spare keys just in case. So the locks were the same make and model, but they were not the same locks. Also, the key for his lock fits my locks and vice versa.

Also, he's been to my house a handful of times over the years, but he was always invited. I didn't know he was perving until I caught him in my room. In the emails he has sent since, he has admitted to being in my house numerous times, and at one point he even spent the night on my couch without permission.

I have spoken to a lawyer and I'm going to go that route.
