Hey guys, I'm looking at the official court records for this case, and it doesn't look good for Trump so far.<br><br>The bad news is that the district judge assigned to the case is Carl J. Nichols. Why is that bad? Well, Nichols is a Trump appointee. I'm not saying that necessarily means the judge is a Trump lover, but it's not the best news either. <br><br>The good news is that Trump's lawyers have filed a motion to dismiss the case that was pretty piss poor.<br><br>The judge isn't impressed with the legal argument. He's basically saying that Trump's lawyers didn't even bother arguing for why the court case should be thrown out. Instead, they're trying to argue that the case is political, and the legal system can't judge a political case. The problem with that argument is that if it's true, then no one could ever be charged with a crime for rioting, because rioting is in itself a political act. The judge basically said that if the case against Trump is political, then the case against the rioters is also political, but both cases obviously need to be tried, so that argument doesn't work in court.<br><br>The judge has also pointed out, repeatedly, that the case against Trump right now has basically nothing to do with the January 6th speech. Instead, the case is about the months long conspiracy Trump engaged in, beginning in the summer of 2020.<br><br>The judge also asked the DOJ what their argument is for holding Trump accountable for the months long conspiracy, in addition to holding him accountable for doing nothing to stop the riot.<br><br>The DOJ has two days to respond to that in writing. Once they do, Trump's lawyers get 2 more days to respond to that. That means that the judge will probably make his ruling at the end of the month. If the judge doesn't throw out half the charges, which it looks like he won't, Trump will be absolutely fucked. <br><br>If the judge doesn't throw out the charges, then the docs are released in mid January, and the case starts going to trial in mid February.<br><br>If the judge throws out more than half the charges, then it's possible that the DOJ can appeal and get the charges reinstated, but they won't be able to do that before the election.<br><br>If the judge throws out all the charges, then Trump is probably off the hook, but it's possible that the DOJ can appeal and get the case reinstated.<br><br>So we'll know more at the end of the month, but right now, it's looking pretty bad for Trump.<br><br>Edit: The judge also asked the DOJ to argue over whether or not Trump should be given docs that are "top secret", redacted or otherwise.<br><br>That's a pretty ominous sign for Trump. I don't think the judge is going to give the Trump campaign any of the docs that could be considered "top secret", or even the redacted versions that have been used in other trials.
