If people are planning to sue OpenAI or Microsoft over these changes, how come nobody is planning to sue GPT4All?

GPT4All is an obvious clone, which you can use for free. No conditions. That is what OpenAI made themselves through GPT3.5 turbo. So if anything is the foundation for the lawsuit, it is how 3.5 Turbo was marketed. Yet GPT4All is a complete clone. Then why is anyone suing OpenAI for changes to a model that already has a free clone?
