I was robbed at gun point. I had a pistol tucked in my waist. The criminals had taken everything from me, when they startled me, I immediately pulled my pistol and aimed it with my finger off the trigger. We talked and they took my phone and wallet. Apparently they were undercover police officers. I was having a mental break down at this point, and somehow managed to get it together enough to go to the police station. when I get there they immediately arrested me, I spent a night in jail, they found my pistol and when I got out, they also charged me with illegal possession. with a lot of hassle, they dropped the illegal possession charge. An hour after they dropped the illegal possession charge they called me again to inform me I had to come down to the police station and pick up my pistol, because otherwise it would be destroyed. I had proof that I had claimed it within the 30 days that the police had to hold onto it. I did not have money to get down to the station and I was not going to pay for an Uber to go get my pistol back. I went down there 3 times and they wouldn't give me my property back because I didn't have the claim slip and a picture of the pistol with the serial number. I finally convinced a friend of mine to give me money so I could go down there with the papers I needed to prove it was mine. They told me a police officer would have to go to his house and sign off on it. I have been waiting for this officer for over a year, I just got off the phone with the police department with him telling me I'm committing a crime by talking to the police department about the pistol they are holding onto for over a year. I was asking them to send in a supervisor to deal with the situation. He told me I no longer own it because I didn't do it in the 30 days they were required to hold onto it. The police took it nearly 5 years ago. The pistol in question is a Glock 23. With the circumstances at the time, I couldn't find one used to buy back. I have been waiting for this pistol for 5 years. I can't believe they would take my property, in addition to arresting me and charging me with a crime that I didn't commit. I had the gun locked in my house when they took the pistol and pistol mags illegally. They were illegal in my state... but since the supreme court ruling, they turned out to be legal. It's been 5 years of constant calls to get my legal property back. They won't give it back to me. I am just really upset.

edit: they arrested me for illegal possession, possession of a firearm without a permit, and jaywalking. The illegal possession charge was for possessing a pistol with a mag capacity of more than 10 rounds. The pistol was sold to me legally with a 10 round mag in it. There was no law that prohibited 10 round mags or greater. I had a 13 round mag in the weapon when they took it. I possessed the pistol with 13 rounds in it. If I did that 5 years ago as possession of a 13 round mag would have been illegal at that time. It turned out, my state had a reversal in the courts that said it was legal to possess. the law at that time prohibits a manufacturer from selling a pistol mag with more than 10 rounds, but there is nothing prohibiting you from possessing a 13 round pistol mag that was manufactured before a certain date. This is the reason I didn't get charged for illegal possession. I was in the right/ They were in the wrong.
